1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of medicare.elyoninsurancegroup.com and elyoninsurancegroup.com, and any related pages, forms, and services (collectively, the "Site") operated by Alpha Omega Center dba Elyon Insurance Group ("Elyon," "we," "us," or "our"). By submitting the plan-review form, calling our listed phone number, visiting our office, joining a virtual appointment, or otherwise using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Site.
You must be Medicare-eligible or eligible to act on behalf of a Medicare-eligible individual, and have the legal authority to enter into these Terms, to use the Site or request a plan review.
2. Description of Services
Elyon is a licensed insurance agency (NPN 7646801) that provides no-cost plan reviews and, where you choose to proceed, enrollment assistance for Medicare Advantage, Medicare Part D, and Medicare Supplement plans.
Important — please read carefully:
- Elyon is not the Medicare program itself, is not a government agency, and is not affiliated with or endorsed by the United States government or CMS.
- Elyon is a Third-Party Marketing Organization (TPMO) and independent licensed insurance agency. We do not offer every plan available in your area — we currently represent 12 organizations which offer 45 products in your area.
- Final approval of any Medicare enrollment is determined solely by CMS and/or the applicable carrier, not by Elyon. Submitting a plan-review form or completing a Scope of Appointment does not guarantee approval, a specific plan, or a specific premium.
- Plan costs, networks, and benefits described on the Site are illustrative and subject to change by the carrier without notice, consistent with annual Medicare plan changes.
3. Eligibility, Scope of Appointment, and Enrollment Process
To receive a plan review through Elyon, you must:
- Be eligible for Medicare, or be an authorized representative of a Medicare-eligible individual;
- Provide accurate, truthful, and current information on the plan-review form and during your appointment;
- Complete a Scope of Appointment (SOA) before any specific plan's benefits, costs, or Evidence of Coverage details are discussed, in accordance with CMS rules;
- Understand that Medicare enrollment is generally limited to specific election periods (such as the Annual Enrollment Period, Medicare Advantage Open Enrollment Period, or a qualifying Special Enrollment Period), and that Elyon does not control CMS's election-period rules.
You are solely responsible for the accuracy of the information you submit. Providing false or misleading information to obtain or change Medicare coverage is a violation of federal law, independent of any action by Elyon.
4. Consent to Be Contacted
By submitting the plan-review form on the Site, you affirmatively consent to be contacted by Elyon and its licensed agents by telephone call, text message (SMS), and email at the number and address you provide — including by automatic telephone dialing system and/or prerecorded or artificial voice — for purposes related to your Medicare plan review, Scope of Appointment, and application status.
- Consent to be contacted is not a condition of eligibility for, or enrollment in, any Medicare plan.
- Message and data rates may apply.
- You may withdraw consent to future contact at any time by replying STOP to any text message, telling a representative during a call, or contacting us using the information in Section 17.
5. No Cost to Request a Review
There is no cost or fee to use the Site, request a plan review, or receive assistance from Elyon. Any premium, deductible, copay, or other cost-sharing amount for a specific plan is set by that plan's carrier and CMS, varies by plan and by your eligibility for subsidies, and is not guaranteed or controlled by Elyon.
6. Enrollment Periods and Plan Changes
Medicare rules generally restrict when you may enroll in or change a Medicare Advantage or Part D plan to specific annual election periods or a qualifying Special Enrollment Period. Elyon does not control, and is not responsible for, CMS's election-period rules or a carrier's annual changes to plan benefits, costs, or networks.
7. Website Use and Prohibited Conduct
When using the Site, you agree that you will not:
- Submit false, fraudulent, or another person's information without their knowledge and authorization;
- Use any automated system, script, or bot to access the Site or submit forms;
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or any connected systems;
- Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law.
We reserve the right to refuse service, decline to process a request, or report suspected fraud to the appropriate carrier, CMS, or law enforcement authorities.
8. Intellectual Property
All content on the Site — including text, graphics, logos, Elyon's name and branding, and the layout and design of the Site — is the property of Elyon or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written permission, except as necessary to use the Site for its intended purpose.
9. Third-Party Carriers and Services
Elyon works with multiple Medicare Advantage, Part D, and Medicare Supplement carriers. Those carriers have their own terms of service, Evidence of Coverage, provider networks, and formularies, which govern the actual plan you receive if you enroll. Elyon is not a party to, and is not responsible for, the terms, performance, network adequacy, or customer service of any third-party carrier.
The Site may contain links to third-party websites or resources, including Medicare.gov. These links are provided for convenience only. Elyon does not endorse, and is not responsible or liable for, the content, accuracy, or practices of any third-party website. You access third-party links at your own risk.
10. Disclaimers
THE SITE AND ALL PLAN-REVIEW SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) YOU WILL BE APPROVED FOR ANY MEDICARE PLAN; (B) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) ANY PLAN OR SERVICE PROVIDED BY A THIRD-PARTY CARRIER WILL MEET YOUR EXPECTATIONS OR BE FREE OF DEFECTS.
Some jurisdictions do not allow certain warranty exclusions, so some of the above limitations may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ELYON, ITS OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR THE PLAN-REVIEW SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. (This liability cap is a template default — confirm the figure with your insurance/E&O carrier and legal counsel before publishing.)
12. Indemnification
You agree to defend, indemnify, and hold harmless Elyon and its officers, employees, agents, and representatives from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) any information you submit through the Site, including any false, inaccurate, or misleading information; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
13. Severability and Waiver
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed. The remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not constitute a waiver of that right or provision.
14. Entire Agreement
These Terms, together with our Privacy Policy (incorporated herein by reference), constitute the entire agreement between you and Elyon regarding your use of the Site and the plan-review services, and supersede all prior understandings on the same subject matter.
15. Changes to These Terms
We may update these Terms to reflect changes in our services, applicable law, or CMS rules. The Effective Date above reflects the date of the most recent revision. We will make reasonable efforts to notify you of material changes. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Alabama, and you consent to personal jurisdiction in those courts. (Since this campaign runs nationwide, confirm with counsel whether an alternate venue clause or state-specific carve-outs are needed for out-of-state applicants.)
